General Terms and Conditions of Purchase for Customers.
These terms apply between you as the end customer (Customer), the business from which you have chosen to order goods (Business), and ES Order, which is operated by Erpato Europe AB (Erpato Europe AB, ES Order), corporate ID no. 556738-2626, with its registered office at Mellangatan 6, 654 55 Karlstad, Sweden. ES Order is a technical platform for ordering and payment. All purchases are made directly between the Customer and the Business, where the Business is the seller and responsible for delivery and customer relations.
ES Order offers an e-commerce platform for restaurants, through which Customers can easily place orders and make payments online.
The Customer visits the Business’s digital menu. The Customer places an order and pays for the selected items. The Business receives the order information as soon as the payment has been completed and can prepare the ordered items according to the Customer’s preferences.
The Customer is solely responsible for collecting the order at the designated point of sale in accordance with the instructions provided online. The Business is under no obligation to replace the Customer’s goods if collection occurs after the specified pickup time. The Business also has the option to independently deliver the ordered goods directly to the Customer (home delivery) or provide them directly on-site through table ordering. ES Order does not provide couriers for home deliveries.
he agreement between the Customer and the Business is considered entered into once the payment has been completed. Payment is made with the Business as the payment recipient. It is the Customer’s responsibility to provide accurate payment information. The Customer will receive a receipt via email. If no email address is provided, it will be considered as the Customer opting not to receive a receipt. All prices displayed within ES Order are in SEK, inclusive of VAT.
Payments can be made via:
a) Card (Visa/MasterCard, Apple Pay, Click to Pay, Google Pay, etc.) via Swedbank Pay (acquiring agreement established through Erpato Europe AB)
b) Swish via Swedbank Pay (acquiring agreement established through Erpato Europe AB)
c) Swish via the Business’s own Swish Handel agreement with their bank or via Northmill Bank.
All payments are processed through a secure, encrypted connection.
Any complaints from the Customer must always be directed towards the Business. Orders are not subject to the right of withdrawal as they are placed within the Business’s premises and concern perishable goods that cannot be resold.
If the Customer has placed an incorrect order online, it is up to the Business to decide on any complaint, cancellation, or modification of the order.
By placing an order through ES Order, the Customer enters into an agreement with the Business. Any financial claims from the Customer must be directed towards the Business. ES Order only provides an ordering system and is not responsible in any way for the Business’s fulfillment of its obligations towards the Customer. It is the Business’s responsibility to ensure that prices and product descriptions are accurate and correct.
ES Order is not responsible for the quality, safety, or legality of goods delivered by the Business.
In the event of a dispute, Swedish law shall apply where these terms do not regulate the conditions, and the Stockholm District Court shall be the court of first instance.
ES Order reserves the right to transfer its rights and obligations under these Terms and Conditions at any time without the Customer’s prior express consent.
We consider personal privacy important and strive for a high level of protection when processing personal data. All information that can directly or indirectly be linked to a physical person is treated as personal data, including but not limited to names, telephone numbers, and email addresses.
The collection of your personal data occurs in connection with ordering goods from the Business. We process all personal data in accordance with applicable legislation under the General Data Protection Regulation (GDPR).
Erpato Europe AB does not engage external partners to perform tasks on behalf of Erpato Europe AB. We do not share your personal data with third parties, except for example with the police in the context of a criminal investigation or otherwise where supported by law or regulatory decision. We do not use your personal data for newsletters or other marketing activities.
We reserve the right to update these terms and conditions. Changes take effect as soon as they are published on this page.
ES Order provides the platform "as is."
We are not responsible for service interruptions, technical errors, lost internet connection, or other technical issues that may affect the ability to complete an order.
Any claims by the Customer related to technical errors must always be directed towards the Business.
The Business is responsible for ensuring that the information about products, contents, prices, and availability presented in the digital menu is accurate and up to date.
ES Order cannot guarantee that all items presented in the Business’s menu will be available at the time of ordering.
We reserve the right for any typographical errors, pricing errors, changes in the assortment, and sold-out items for each Business. Any inaccuracies in pricing or product information may be corrected afterwards.
ES Order provides its service on an "as is" basis, without warranties of any kind, either express or implied.
We are not responsible for indirect damages, loss of profits, or economic loss arising from the use of or inability to use the service.
Any claims related to orders must always be directed towards the Business.
ES Order reserves the right to change, limit, or terminate access to the service at any time without liability to the Customer.
To use ES Order’s service and place an order, the Customer must be at least 18 years old.
By using the service, the Customer confirms that they are at least 18 years of age and have the legal capacity to enter into binding agreements.
The Business may request proof of age upon pickup or delivery of ordered goods, especially for orders containing age-restricted products such as alcohol.
In case of suspected misuse or incorrect information, ES Order reserves the right to cancel or refuse orders without prior notice.
All content and technology used in ES Order, including but not limited to software, graphics, logos, and text, are owned by Erpato Europe AB or its licensors and are protected by Swedish and international intellectual property law.
No part of the service may be copied, reused, or distributed without written permission from Erpato Europe AB.
ES Order and the Business are released from liability for failure to fulfill obligations under these terms due to circumstances beyond their reasonable control, such as natural disasters, wars, government actions, strikes, pandemics, or other unforeseen events.
